Web Acadian reserves the right to change these Policies and Conditions without notice. It is the responsiblity of the individual to verify current policy and conditions.

Warranty

Web Acadiana warrants that we will provide our clients with quality web sites in accordance with the information provided by our clients. Customer Satisfaction is our highest priority.

Web Acadiana does not warrant that the operation of the web site will be uninterrupted or error free. In no event will Web Acadiana be liable for any incidental, indirect, special or consequential damages whatsoever (including but not limited to lost profits) arising out of or related to any information contained herein, even if Web Acadiana has been advised of the possibility of such damages.

Required Items For Design And Development

Client agrees to provide text information that is to be included in client’s web site and to email information to Web Acadiana. Failure to provide text information via email may result in additional charges at standard hourly rates while entering information into client’s web site. Images, graphics and pictures which client provides for inclusion into the web site, should be emailed to Web Acadiana. Failure to do so may result in scanning and/or editing charges billed at standard hourly rate.

Required Items For Updates

Update information for web sites should be sent via email to establish a record of the update request and the required update information.

Third Party Programs

Web Acadiana does not warrant or guarantee any third party programs that may be installed by Web Acadiana on behalf of client. Any such programs used for client’s web site that may require future updating and/or upgrading will accrue charges being billed to client for doing so.

Domain Names, Hosting, and Maintenance Renewals

Domain Names, Hosting and Maintenance contracts will not be renewed until payment for such has been received by Web Acadiana. In the event of an expiration of a domain name, no guarantee can be made that it will be available for renewal again after the expiration date.

Payment of Fees

Payments due must be made by due date. Non payment will result in suspension of web sites on the Internet covered by the invoice until such time as payment has been received. Suspended web sites are subject to a reactivation fee of $75.

Web Acadiana accepts cash, checks, money orders, Visa, Master Card and PayPal.

Non Sufficient Funds

A $25 NSF fee will be charged each time a check is returned as NSF.

Refunds

Refunds will not be made on web site design and/or update work started or completed or for domain name registration.

Ownership of Web Pages

Copy of the finished work of web pages by Web Acadiana is owned by Web Acadiana until payment for the service preformed is made. Any rights to images, photos, graphics, source codes, files, and or computer programs are not transferred to the client, and remain the property of their respective owners. Web Acadian retains the right to display graphics and other Web Design as examples of work in our portfolio.

Copyrights, Trade Marks and Trade Names

The client represents to Web Acadiana and unconditionally guarantees that any elements of text, graphics, images, photos, designs, trade marks, trade names, or other artwork furnished to Web Acadiana for inclusion into web pages are owned by the client, or that the client has permission from the owner to use each of these elements, and will hold harmless, protect, and defend Web Acadiana from any claim and/or suit arising from the use of such elements furnished to Web Acadiana by the client.

Disclaimer

If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be removed from this agreement but shall not affect the validity of any remaining provisions.
